What is a Foreclosure?

Foreclosure is the legal proceeding in which a bank or other secured creditor sells or repossesses a parcel of real property (immovable property) due to the owner's failure to comply with an agreement between the lender and borrower called a "mortgage" or "deed of trust". Commonly, the violation of the mortgage is a default in payment of a promissory note, secured by a lien on the property. When the process is complete, it is typically said that "the lender has foreclosed its mortgage or lien." In other words, an entity was owed money and the property was used as collateral. If the amount wasn't repaid then entity owed attempts to foreclose on the house, instead of the payment.

It is referred to the process after the lis pendens is issued and the foreclosure process started. During this period the original owner retains title to the property.

It is legal collateral against a piece of real estate. It can be taken out by various sources: Banks, government and a plumber.

What is a Lis Pendens?

It is a document that is issued by a lienholder, through the courts, that outline their intent to foreclose on the property. It is filled with all the relevant data of the property, liens and owners.

Most of the time it will be every business day, as they are served in court. At time they won't be updated, that would be a rare occurrence.

No, but we get 99% of them.

Can I print a copy of the ENTIRE lis pendens?

Yes, although the searchable database has a wealth of information, nothing beats the actual lis pendens document.

Do you guarantee that all the information regarding the lien is on the lis pendens?

No, we don't guarantee anything.
